Query: Court No. - 6 Case :- CONTEMPT No. - 2209 of 2009 Petitioner :- Sunil Kumar Rai Respondent :- Sri Pradeep Shukla Petitioner Counsel :- Dr.L.P. Misra Hon\'ble Shabihul Hasnain,J. In compliance of Court\'s order, Dr. Shobh Nath, Director, Para Medical, Directorate of Medical and Health Services, U.P., Lucknow is present before this Court. He has been heard in person for quite sometime. Sri A. P. Singh, learned Counsel has also assisted in the matter. It appears that there is some confusion in the mind of the Officer, who is present before this Court. Today, after reading the Division Bench order as well as the Supreme Court order, he says that he is clear in his mind that the at first 170 candidates of twelve special appeals are to be adjusted and later on in chronological order of decision of the writ petitions either here or in Supreme Court, the candidates will be adjusted and a sequence will be adopted. The benefit to others have to be given after the original order, which was passed by the Division Bench on 04.05.2009. The Officer says that he cannot pass order unless approval is granted by the Director General, Medical and Health, U.P., Lucknow. But, he assures the Court that he will comply with the orders as understood by him today in presence of all the counsels, with the observations of this Court. He assures that he will complete this exercise within a period of one month from today. List this case on August 16, 2011. In case there is a problem for getting approval from Director General, Directorate of Medical and Health Services, U.P., Lucknow, the Director General, Directorate of Medical and Health Services, U.P., Lucknow, along with Dr. Shobh Nath, Director, Para Medical and Health Services, will appear before this Court on the said date. It is made clear that none of the orders passed by this Court or the Hon\'ble Apex Court has given any direction to exceed the number of seats i.e. 766, which was originally advertised. If the list is published and the appointments are given by next date, the Officers need not appear. Order Date :- 12.7.2011 RS. |
